§1 General provisions

  1. The privacy policy defines the methods of collecting, processing, sharing, and storing personal data necessary to provide electronic services via the online store www.degnergallery.com, hereinafter referred to as the Gallery.
  2. The Gallery collects personal data solely for the purposes necessary to provide and develop the services it offers.
  3. Personal data collected through the Gallery is processed in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and the Personal Data Protection Act of May 10, 2018.

 

§2 Data administrator

  1. The administrator of personal data collected via the Gallery is Uni Artis Ryszard Szymański with its registered office in Bielany Wrocławskie, ul. Akacjowa 2, Poland.

 

§3 Data acquisition

  1. Personal data is collected during the following activities:
    1. concluding a sales contract,
    2. concluding a consignment contract,
    3. subscribing to the newsletter,
    4. contacting us via the contact form,
    5. providing other services.
  2. Providing data is voluntary, but necessary to conclude a contract or use other features of the Gallery.

 

§4 Data processing

  1. Personal data is processed for the following purposes:
    1. fulfillment of the sales contract,

    2. fulfillment of the consignment contract,

    3. sending the newsletter,

    4. processing payments,

    5. handling complaints,

    6. communication,

    7. analytical and statistical purposes,

    8. marketing, remarketing, and affiliate purposes,

    9. tax and accounting purposes,

    10. debt collection, and conducting court, arbitration, and mediation proceedings.

  2. The administrtor may process the following personal data::
    1. first and last name,

    2. date of birth,

    3. residential address or mailing address,

    4. identity document number,

    5. email address,

    6. phone number,

    7. bank account number,

    8. tax identification number.

  3. Where the basis for data processing is the performance of a contract, personal data may be processed for the duration of the contract, and after its termination until the statute of limitations expires for claims arising from its performance or the fulfillment of obligations under applicable law, including in particular tax and accounting regulations.

  4. Where the basis for data processing is consent, personal data may be processed until such consent is revoked, and after revocation, until the statute of limitations for claims expires.

  5. In both of the above cases, the statute of limitations is 6 years, and for claims regarding periodic benefits and claims related to business operations—3 years (unless specific provisions provide otherwise).

 

§5 Data sharing

  1. Personal data may be disclosed to entities affiliated with the administrator, its subcontractors, and entities cooperating with the administrator, such as companies handling electronic payments, courier or postal service providers, law firms, and accounting firms.
  2. In specific situations provided for by Polish law, personal data may be disclosed to state institutions and authorities. 

 

§6 Rights related to data processing

  1. You have the following rights regarding the processing of your personal data:
    1. the right to access your personal data,
    2. the right to request the correction of your personal data,
    3. the right to request the deletion of your personal data,
    4. the right to request the restriction of the processing of your personal data,
    5. the right to data portability,
    6. the right to object to the processing of your personal data,
    7. the right to withdraw consent to data processing (which does not affect the lawfulness of personal data processing carried out on the basis of consent prior to its withdrawal).
  2. To exercise the above rights, please contact the Gallery using the contact form available on the Gallery’s website or by writing directly to info@degnergallery.com.
  3. You also have the right to file a complaint regarding the Gallery’s processing of personal data with the supervisory authority, which is the President of the Personal Data Protection Office.

 

§7 Cookies

  1. The Gallery uses cookies. The use of cookies supports the proper provision of the Gallery’s services and serves statistical purposes. By allowing your browser to save cookies on your computer, you consent to their processing. Cookies do not cause any configuration changes to users’ computers or software. Users visiting the Gallery may prevent cookies from being stored on their computers or permanently delete such stored cookies by modifying their web browser settings.

 

§8 Final Provisions

  1. The Administrator reserves the right to amend this Privacy Policy by publishing a new privacy policy on the Gallery’s website, provided that users’ rights are not restricted.
  2. In matters not covered by this Privacy Policy, the provisions of the GDPR and Polish law shall apply.
